1. Scope of Use and License

(a) This webpage (“Webpage”) is owned and operated by Remote Control Technologies Pty Ltd (“RCT”).

(b) By accessing the Webpage or downloading the materials made available (“Materials”) on the Webpage, you agree with and accept the following terms and conditions (“Terms of Use”) governing your use of the Webpage and the Materials.

(c) You may access the Webpage or use the Materials for purposes approved by RCT only. The approved purposes include sales, marketing and technical-related purposes (“Approved Purposes”).

(d) RCT reserves the right at any time, at its sole discretion, to make any changes to the Terms of Use and you are deemed to have accepted the then Terms of Use by continuing to access or utilise the Webpage.

2. Authorised users

(a) Access and use of the Webpage is limited to Jungheinrich’s employees (“JH Personnel”).

(b) You represent and warrant that you are an employee of Jungheinrich.

3. Access and security

(a) If you are given the log-in details or password (“Log-in Details”) to the Webpage or you have knowledge of the Log-in Details, you must keep the Log-in Details confidential and secure.

(b) You may share the Log-in Details with other JH Personnel on a need-to-know basis only.

(c) RCT may cancel, suspend or alter the Log-in Details at any time if it forms a reasonable belief that an unauthorised person has knowledge of the Log-in Details.

(d) If you suspect that an unauthorised person has knowledge of the Log-in Details or may be accessing or utilising the Webpage, you must notify RCT immediately.

4. Intellectual property rights

(a) Unless otherwise indicated, RCT owns all rights, title and interest (including copyright, designs, patents, trademarks and other intellectual property rights) in the Materials.

(b) By RCT’s grant of a licence to you to use the Webpage or the Materials, RCT does not grant or transfer (or purport to grant or transfer) any rights, title or interest in the Materials to you.

(c) You must not copy, reproduce, modify the Materials unless RCT has given prior written consent to you.

5. Warranties, liability and disclaimers

(a) To the maximum extent permitted by law, RCT makes no warranties or representations about the Materials, including but not limited to warranties or representations that the Materials are complete, accurate or up-to-date. RCT will use best endeavours to ensure the Materials are complete and accurate.

(b) To the maximum extent permitted by law, RCT disclaims all liability for any loss or damage suffered by Jungheinrich or JH Personnel for relying or acting on the Materials.

(c) Jungheinrich and you must not make any misleading, deceptive or false representation, statement or claim as to the contents in the Materials or about RCT’s products or services, to any person.

6. Updates

RCT may but is not under any obligation to update the Materials. If RCT updates the Materials and requires Jungheinrich or you to cease using or distributing the outdated materials, you must comply with RCT’s requirement.

7. Confidentiality

(a) The Materials are confidential information of RCT. You must not copy, reproduce or modify the Materials unless RCT has given prior written consent. You must not use, disclose or distribute the Materials for purposes other than for the Approved Purposes or unless RCT has given prior written consent to you.

(b) You must protect the Content against unauthorised access, use or disclosure.

8. Indemnity

Jungheinrich indemnifies RCT against any claim, loss, demand, cost or expense suffered or incurred by RCT arising out of or as a consequence of a breach of any of the Terms of Use by Jungheinrich and/or JH Personnel.

9. General

(a) Your use of the Webpage and the Terms of Use are governed by the laws of Western Australia and you submit to the exclusive jurisdiction of the courts exercising jurisdiction in Western Australia,

(b) If any of the Terms of Use is held to be invalid, unenforceable or illegal for any reason, the remaining Terms of Use will continue in full force.
